Affiliate Terms

These Affiliate Terms govern participation in the Friend in LA Affiliate Program, including enrollment, commissions, holds, payouts, promotion rules, and termination.

1. Program overview

The Friend in LA Affiliate Program (“Program”) lets approved partners (“Affiliates,” “you”) refer new users with tracked links or codes and earn commission on qualifying net revenue. Participation also requires acceptance of our Terms of Use, Privacy Policy, and Community Guidelines.

2. Enrollment and eligibility

  • You must be at least 18 and able to receive payouts in a supported method/region.
  • Create a Friend in LA account and complete the affiliate application.
  • We may approve, reject, suspend, or remove Affiliates at our discretion based on brand fit, traffic quality, promotional methods, and compliance history.
  • Approval is not guaranteed and may be revoked.

3. Independent contractor status

You are an independent contractor, not an employee, partner, or agent of Friend in LA. You may not bind us contractually or represent that you are employed by us. You are responsible for your own taxes, expenses, and marketing compliance.

4. Commission rate and qualifying revenue

Unless a separate written deal states otherwise, the default commission is 10% (1000 basis points) of qualifying net amounts Friend in LA actually collects from referred users on eligible products.

Qualifying purchases typically include eligible Plus and Premium subscription charges and catalog products marked affiliate-eligible. Unless expressly included in writing, the following are not commissionable or are adjusted out of the net base:

  • Free signups alone
  • Taxes, tips, and amounts passed through
  • Processor fees, discounts, credits, and chargebacks
  • Refunded transactions
  • Elite setup fees or other products we designate as non-commissionable
  • Self-referrals, fraud, or policy-violating traffic

5. Attribution

Unless otherwise agreed in writing, we use last-click attribution within the cookie/attribution window shown in the affiliate dashboard. You must not alter tracking parameters in a way that breaks attribution integrity. Cookie stuffing, forced redirects, and malware are prohibited.

6. Hold period

Commissions remain pending for 30 days after the underlying charge clears to cover refunds and disputes. After the hold, eligible amounts move to payable balance subject to minimum payout thresholds and successful identity/tax onboarding.

7. Payouts

  • Payout schedule and minimums are shown in the affiliate dashboard (typically monthly).
  • You must provide accurate tax documentation (for example W-9 or W-8) before receiving payouts above applicable thresholds.
  • We may withhold or delay payouts while investigating suspected fraud or policy violations.
  • You are solely responsible for reporting and paying taxes on commissions.

8. Permitted promotion and disclosures

You may promote Friend in LA on owned channels (websites, newsletters, podcasts, social accounts) consistent with these Terms and applicable law. You must clearly disclose the affiliate relationship in accordance with FTC Endorsement Guides and any similar rules (for example “#ad” / “affiliate link” where appropriate).

Prohibited promotional methods include (non-exhaustive): spam; unsolicited bulk messaging; misleading claims about verification, Elite, safety, or dating outcomes; impersonating Friend in LA staff; bidding on our trademarks without written permission; incentivized fake signups; adult/illegal/hate inventory that damages the brand; and any method that compromises member trust.

9. Brand license

We grant a limited, revocable, non-transferable license to use approved logos and copy solely to promote the Service. Do not alter logos, create confusingly similar marks, or imply that Friend in LA endorses your unrelated products or guarantees matches.

10. Refunds, reversals, and clawbacks

If a referred purchase is refunded, charged back, or later determined fraudulent or ineligible, related commissions are reversed from pending or future payouts. Negative balances may offset future earnings. We may require repayment of already-paid commissions obtained through fraud.

11. Data and privacy

You must not collect or misuse personal information of referred users beyond what is necessary for your own marketing and permitted by law. You must not claim to provide Friend in LA account support or request passwords. Our Privacy Policy governs how we process referral and conversion data.

12. Records and audit

We may review traffic quality, conversion patterns, and promotional materials. You agree to cooperate reasonably with fraud or compliance investigations related to your participation.

13. Termination

Either party may terminate Program participation with notice. We may suspend or terminate immediately for violations, fraud risk, or brand harm. Upon termination for convenience, eligible held commissions that later clear may still be paid. Upon termination for cause, unpaid commissions may be forfeited to the extent permitted by law. Sections on brand use end, confidentiality, clawbacks, indemnity, and liability survive.

14. Disclaimer and limitation of liability

THE PROGRAM IS PROVIDED “AS IS.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Our aggregate liability arising from the Program is limited to unpaid commissions properly earned and payable at the time of the claim, except where liability cannot be limited.

15. Indemnity

You will indemnify Friend in LA against claims arising from your promotional content, disclosure failures, unlawful marketing practices, or breach of these Affiliate Terms.

16. Changes

We may update commission rates, hold days, eligible products, attribution rules, or these Terms with notice to active Affiliates (dashboard notice and/or email). Continued participation after the effective date constitutes acceptance. If you disagree, stop promoting and terminate participation.

17. Governing law

These Affiliate Terms are governed by California law. Dispute resolution terms in the Terms of Use apply unless a written partner agreement states otherwise.
